Freely available healthcare, universally accessible to the population of citizens, is a key ideal for European welfare systems. This article deals with the decision taken by the Court of Justice of the European Union in Sopora (Case C-512/13), which was decided by the Grand Chamber of the ECJ on 24 February 2015. It concerns the question of whether a specific requirement to obtain a tax advantage for foreign (incoming) workers violates the freedom of movement of workers (Art. 45 TFEU). Freedom of movement of workers within the EU implies adequate regulation of risks incurred by workers on the occasion of the exercise of this freedom. Among these risks, there is the possibility for community workers to lose or at least find themselves unable to give their supplementary retirement pension individual rights an unitary and continuous character when they decide to settle in another member State. What are the legislative solutions already proposed by the Community legislature and even those expected by community workers to be protected from these dangers? The article deals with the notion of personal freedom as it is regulated by art. 13 of Italian Constitution, drawing the main differences with other fundamental rights, in particular with the freedom of movement (art. 16 Cost.). The paradigms of car and air travel are contested in terms of climate change; I continue the contestation from the perspective of political liberty. Three paradigms of personal travel – by car, by flight and by train – are confronted with two concepts of liberty: the freedom from interference versus the freedom from dependence.
